When is the EPC mandatory?

In Flanders the EPC must be issued before any listing, whether for sale or rental.

Residential sale

An EPC is mandatory as soon as a residential property is advertised. The original is handed over to the buyer at the deed of sale.

Residential rental

For any residential property listed for rent, a copy of the EPC must be provided to the tenant when the lease is signed.

Common areas

The EPC GD is mandatory for any building of 2 or more units, regardless of any transaction.

Small non-residential

The EPC kNR is mandatory for shops, offices and commercial premises of less than 500 m² when sold or rented.

Responsibilities of each party

Each actor has specific obligations regarding the EPC certificate.

Owner-seller

  • Have the EPC issued before listing
  • Guarantee access to all rooms
  • Provide proof and technical documents
  • Hand over the original to the buyer

Owner-landlord

  • Valid EPC before listing for rent
  • Display label and score in adverts
  • Give a copy of the EPC to the tenant
  • Keep the original certificate

Property manager (syndic)

  • Have the EPC GD issued
  • Guarantee access to the boiler room
  • Provide technical documents
  • Coordinate access to common areas

Notary

  • Verify the presence of a valid EPC
  • Check certificate compliance
  • Report missing EPC to VEKA
  • Ensure transfer of the original

Boiler room (stookruimte):  The property manager must guarantee access to the collective boiler room. Without inspection of centralised systems, the certificate is incomplete.

Advertising obligations

Energy information must appear in every property advertisement.

Failure to comply with EPC obligations is sanctioned with administrative fines imposed by VEKA.

Supervision by VEKA

The Vlaams Energie- en Klimaatagentschap (VEKA) oversees compliance with EPC regulations. Notaries must report any transaction without a compliant certificate.

Fines are cumulative: a single transaction can trigger multiple sanctions (no EPC + non-compliant ad + failure to deliver).
